For over 35 years Mukesh Advani has helped individuals and businesses use practical business solutions to resolve legal disputes. This approach has resulted in substantial cost savings to his clients and allowed them to focus on their core business.Not all disputes resolve early and some need to go through litigation in the Court system. When they do, Mukesh is a highly skilled and passionate advocate who has represented business, both small and large (including Fortune 500 Companies), and individual clients in court.
Mukesh’s experience includes a wide range of civil litigation, including insurance, employment, commercial, business, and real estate law litigation. And should an appeal be necessary, Mukesh has significant appellate law experience, including having represented several clients on appeal which resulted in published California appellate court decisions.
In employment litigation, Mukesh has defended employers in cases involving wrongful
termination, wage and hour violations, discrimination, harassment, and retaliation in various
forums, including California Courts, state administrative agencies (e.g., the Labor
Commissioner, the California Department of Fair Employment and Housing and Equal
Employment Opportunity Commission.)
In addition to employment litigation, Mukesh has assisted Clients in drafting and updating
employee handbooks and policies, advising clients on their ever-changing obligations under the
law, including wage and hour laws, overtime, meal and rest breaks, sick leave, exempt and non-
exempt status, employment agreements and independent contractor agreements, disciplinary
actions, including termination, and investigation of allegations of harassment, including sexual
harassment.
For the last three decades, Mukesh has been continuously rated A.V. (very high (legal ability) to
preeminent) by Martindale-Hubbell and included in its Bar Register of Preeminent Lawyers.
Mukesh is also included in the 2014, 2015, 2018, 2019, 2020, and 2021 edition of the Northern
California Super Lawyers. Mukesh has published articles, authored white papers, and taught
continuing legal education classes on cutting edge legal issues, including Employment Law,
Insurance Law, Privacy Laws and Regulations, Corporate Ethics, Law Practice Management
Issues, and Appellate Law at many prestigious forums, including at the American Bar
Association’s annual convention and at the annual convention of National Asian Pacific
American Bar Association.
Mukesh is the founder and past president of the original South Asian Bar Association (“SABA”)
in San Francisco which was the inspiration for formation of dozens of SABA chapters across
North America with thousands of members. Mukesh has also served as a member of the
California Committee of Bar Examiners, the Ethnic Minority Relations Committee of the State
Bar of California, and the executive committee of the International Law Section of the State Bar
of California. Mukesh has served as a Board Member and President of the Employment Law
Section of the Contra Costa County Bar Association. Mukesh has received several awards,
including, Minority Bar Coalition’s Award for Outstanding Service to Community, SABA’s
20th Anniversary Award, and the Indo-American Community Federation’s Leadership Award.
Mukesh started award winning free legal clinics at the India Community Center in Milpitas,
California, which are open to general public.
During Mukesh’s 35+ years of practicing law, he has been a partner in, co-founder of, owned,
and/or managed law firms in the California Bay Area and Southern California, including his own
firm from 1990 to 1998 that he grew to eight attorneys with offices in Northern and Southern
California.
Mukesh is once again the owner of his own law firm. Mukesh brings substantial experience,
knowledge and business savvy independently handling business and employment matters on a
